Mon Naturel by Muriel — Terms & Conditions

1. Who we are

2. Scope
These Terms & Conditions apply to every offer, order and agreement concluded through monnaturelbymuriel.com and to every purchase made at our showroom, to the exclusion of any other terms. By placing an order you accept these terms. Deviations are valid only if we have confirmed them in writing.

3. Products — natural cosmetics
We sell natural hair, skin and body care products, handcrafted in small batches. Because we work with natural raw ingredients, slight variations in colour, scent or texture between batches are inherent to the product and do not constitute a defect. Our products are cosmetics, not medicines; they are not intended to diagnose, treat, cure or prevent any disease or condition, and no statement on this website should be read as a medical claim. You are responsible for reading the ingredient (INCI) list before purchase and use, and for performing a patch test before first use of any new product. We accept no liability for reactions resulting from failure to do so, from use contrary to the instructions, or from continued use after irritation appears (see §10). Store products cool, dry and out of direct sunlight; shelf life after opening is indicated by the PAO symbol on the packaging.

4. Ordering and contract
Your order constitutes an offer to purchase. A contract is concluded only when we send an order confirmation by email; until then we may decline any order without giving reasons. We sell to consumers for personal use only and may limit order quantities and refuse orders that appear to be for resale, are placed with incorrect or unverifiable details, or that we reasonably suspect to be fraudulent. If a listing contains an obvious error — including a clearly incorrect price or description — we may cancel the affected item even after confirmation; we will refund any amount already paid for it, and no further compensation is due. All prices are in euros and include Dutch VAT. Payment is due in full at checkout through the payment methods offered. We may change prices and assortment at any time; the price at the moment of your order applies.

5. Shipping and delivery
We ship from the Netherlands via PostNL. Shipping costs are calculated automatically at checkout. Orders over €80 to the Netherlands and Belgium ship free of charge. All delivery times shown are estimates and are not binding; carrier delays do not entitle you to compensation. Only where delivery has not taken place within 30 days (or another expressly agreed term) may you dissolve the purchase, in which case we refund the amount paid for the undelivered items. The risk of loss or damage during transport passes to you upon delivery. Local pickup at our showroom (Veluwezoom 7, Almere — strictly by appointment) is free.

6. Retention of title
All delivered products remain the property of Mon Naturel by Muriel until every amount you owe us under the agreement has been paid in full.

7. Right of withdrawal and hygiene exemption
As a consumer you may withdraw from your online purchase within 14 days of receipt without giving a reason, subject to the exclusions below. For reasons of health protection and hygiene, products that are sealed and have been unsealed or opened after delivery are excluded from the right of withdrawal (Article 16(e), Directive 2011/83/EU; Article 6:230p Dutch Civil Code). All our cosmetic products are delivered sealed. You may inspect a product as you would in a shop — look, hold, smell the outer packaging — but once a seal is broken, the product cannot be returned under any circumstances. The full procedure, conditions and model form are set out in our Returns & Refund Policy, which forms an integral part of these terms. The statutory right of withdrawal applies to distance (online) sales only; purchases made and collected in person at our showroom are final.

8. Gift cards
Digital gift cards are valid as stated at purchase, can be used only in this webshop, cannot be exchanged for cash, and any remaining balance is not paid out in money. Lost, stolen or shared gift card codes are not replaced. A gift card can be withdrawn within 14 days of purchase only if it is entirely unused; once fully or partially redeemed, withdrawal and refund are excluded.

9. Legal guarantee (conformity)
You are entitled to a product that conforms to the agreement (Book 7 Dutch Civil Code). If a product is defective or not what you ordered, contact us with your order number as described in the Returns & Refund Policy. Where a claim is justified we will repair or replace the item, or refund it where repair or replacement is not reasonably possible. The guarantee does not cover normal wear, natural batch variation (§3), damage caused by incorrect storage or use, products used beyond their PAO period, or reactions attributable to individual sensitivities where the ingredients were correctly declared.

10. Liability
Nothing in these terms limits liability that cannot lawfully be limited. In all other cases: (a) we are not liable for damage caused by use of a product contrary to its instructions or intended purpose, failure to read the ingredient list, failure to perform a patch test, or continued use after irritation or an allergic reaction has appeared; (b) we are not liable for indirect or consequential damage; and (c) our total liability per order is limited to the amount you paid for the product(s) concerned. Advice given by us in the showroom, by email or on social media is general in nature and never a substitute for advice from a physician or dermatologist.

11. Force majeure
We are not obliged to fulfil any obligation while prevented by circumstances beyond our reasonable control, including supplier or raw-material shortages, carrier failures or strikes, energy or network failures, extreme weather, illness, government measures, or disruptions at Shopify or payment providers. If force majeure lasts longer than 60 days, either party may cancel the affected order; amounts already paid for undelivered products are refunded, and no further compensation is due.

12. Intellectual property
All content on this website and our packaging — including texts, product names, formulations and recipes, photographs, videos, graphics and the Mon Naturel by Muriel name and logo — is our property or used under licence. Nothing may be copied, reproduced, scraped or used commercially without our prior written consent. Product photos are illustrative; the delivered product may differ slightly (see §3).

13. Showroom
Our showroom at Veluwezoom 7, Almere is open strictly by appointment, booked via the Book a Visit page. We may refuse or reschedule appointments and refuse entry at our discretion. Visits are at your own risk; we are not liable for loss of or damage to visitors' personal property.

14. Complaints
Submit complaints first to info@monnaturelbymuriel.com with your order number; we respond within 14 days. Submitting a complaint does not suspend any payment obligation. If we cannot resolve the matter together, you may turn to ACM/ConsuWijzer or, for cross-border purchases, your local European Consumer Centre (ECC).

15. Applicable law and forum
Dutch law applies exclusively to these terms and all agreements with us; as a consumer you also retain any protection granted by mandatory law of your country of residence. Disputes are brought before the competent Dutch court, unless mandatory law designates another forum.

16. Changes and severability
We may amend these terms at any time; the version published at the time of your order applies to that order. If any provision is held invalid, the remainder stays in force and the invalid provision is deemed replaced by a valid provision that most closely matches its intent.
